How Does One Apply?

o   How does one apply for formal kinship care?
§  According to New Mexico Administrative Code [8.26.4.16 RELATIVE FOSTER CARE], Relatives who provide foster care to children in PSD custody must be licensed. See Policy section for more details
§  A petition for order appointing kinship guardianship must be filled out and submitted to the district court for a formal ruling by the presiding judge. Included in the petition are forms which include;
·         Information about the petitioners
·         Request for court to name petitioners as kinship guardians of a minor child
·         Information about the child’s parents
·         Information about other cases
·         Child over fourteen years of age or married
·         Child support

§  A request for hearing must be filed with the district court.
§  Parental consent to appointment of guardian and waiver of service process (paternity admitted)
·         Parents of the child
·         My agreement to give the kinship guardians my legal rights and duties as a parent.
·         Child support obligation
·         Consent to appointment of guardian
·         Waiver of right to service of summons and petition
·         Right not to sign
·         Right to withdraw consent
